Return of Ordered Items

If the delivered Goods are of inadequate quality due to a manufacturing defect or they got damaged during their transportation, the Customer has the right to return the Goods or exchange them for similar Goods of adequate quality (provided such Goods are currently in stock), as well as to demand a free-of-charge elimination of defects found in the Goods or a compensation of the costs incurred by the Customer for the elimination of such defects. If a similar item of good quality is not in stock, the Customer can return the item of inadequate quality, or wait until the Seller receives the item the Customer needs. All claims for the refund of the amount paid for the Goods shall be settled within 10 days from the date of the Seller's receipt of such claim (Article 22 of the On Protection of Consumers' Rights Law of the Russian Federation). Thus, the amount paid for the returned Goods will be refunded to the Customer within 10 days following the return of the Goods; if the returned Goods are of inadequate quality, the Customer will also be refunded the amount paid for the Goods delivery (apart from the amount paid for the item itself). The time needed for the funds to be transferred to your account depends on the terms established by the internal regulations of the respective banks. According to Article 26.1 of the Law On Protection of Consumers' Rights, as well as Paragraph 21 of the Decree of the Russian Federation Government dd. 27.09.07 On Approval of the Rules for the Sales of Goods by Remote Means, the Customer has the right to refuse the ordered Goods at any time before their actual hand-over, and within 7 days after the hand-over. According to Article 25 of the law On Protection of Consumers' Rights the consumer has the right to exchange a non-food product of good quality for a similar product with the seller from whom the product was purchased, provided the specified product did not satisfy the consumer in terms of its shape, dimensions, style, color, size or configuration. The list of goods of adequate quality that are not subject to exchange is approved by Resolution No. 55 of the Government of the Russian Federation dd. 19.01.1998. Thus, the following goods (including goods of adequate quality) are not subject to return or exchange:

  • Personal hygiene items (combs, hair clips, hair bands, hair curlers, wigs, hairpieces and other similar products);

  • Perfumery and cosmetic products;

  • Sewn and knitted products (sewn and knitted underwear, hosiery products);

  • Products made of precious metals, with jewels, of precious metals with inserts from semiprecious and synthetic stones; faceted precious stones;

  • As well as other products approved by the above Resolution.

According to Paragraph 12 of Resolution No. 684 dd. June 15, 1994 about the approval of Rules for the Sale of Products Made of Precious Metals and Jewels in accordance with the On Protection of Consumers' Rights law of the Russian Federation, the products made of precious metals and jewels are not subject to exchange and return, except in cases when they contain certain defects not stipulated by the Seller (weak fastening of stones, locks in earrings, hinged connections in bracelets, cracks, chips, scratches, burrs and other defects), or in cases of the non-conformance of the print left by the state assay stamp of the Russian Federation to the actual assay of the jewelry alloy, or the non-conformance of product features to data specified on the label or in the quality certificate.

The return of adequate-quality Goods is possible without specifying the reasons, provided the Goods were not in use, their marketable state (packing, seals, labels) and consumer properties are preserved, and the documentation confirming the fact and conditions of purchase of the specified Goods (sales or cash register receipt) is also present.

Goods purchased from other companies are not accepted for return. 

The Customer has to perform all of the following actions in order to return the Goods: 

The Application must include the payment details for the refund:

  • Name, last name, patronymic 

  • Name of the Beneficiary Bank; 

  • Beneficiary Bank BIC; 

  • Correspondent account number; 

  • Settlement account number. 

When asking for a refund, the Customer has to attach copy of the 1st page of their passport or other identity document (according to the Regulations of the Central Bank of the Russian Federation dd. October 12, 2011 No. 373-P: REGULATIONS ON ORDER OF CASH TRANSACTIONS WITH BANKNOTES AND COINS OF THE BANK OF RUSSIA ON THE TERRITORY OF THE RUSSIAN FEDERATION).

The Customer is also required to attach a sales or cash register receipt, an Application form filled-out in accordance with the instructions provided by the Seller, as well as a copy of the identity document, and send them to the Seller via the EMS Department of Russian Post together with the Order, declaring the full costs and the inventory of the enclosed items, using the following address of the Seller: IP Varivoda E.V. 103 Oktyabrskaya Street, bldg 2. Moscow, 127521.

The return of the Goods is carried out at the Customer's expense. Sending the returned Goods by the cash-on-delivery service is not allowed. The Customer shall bear all risks associated with the non-compliance with the rules for the Order return. 

When returning the adequate-quality Goods, the cost of the Goods is refunded to the Customer. The delivery costs and the costs of return shipping are not compensated to the Customer. 

Claims regarding the inadequate-quality Goods or the non-complete Goods (absent in the package).

The inadequate-quality Goods are the goods that have defects and cannot be used in accordance with their initially stated functional qualities. If the elements of design, as well as shades of colors of the Goods differ from those stated in the description on the Website, this is not considered to be a defect or malfunction of the Goods. 

To return or exchange the inadequate-quality Goods, the Customer has to:

  • Carefully pack the Goods that the Customer wishes to return with all components and a full set of accessories specified in the Goods technical documentation;

  • Fill in 2 copies of the Application for the return or exchange of inadequate-quality goods or state the absence of Goods in the package. 

The Application must include the payment details for the refund:

  • Name, last name, patronymic

  • Name of the Beneficiary Bank;

  • Beneficiary Bank BIC;

  • Correspondent account number;

  • Settlement account number.

When filling out an application for the absence of Goods in the package, the application must be accompanied by an Act drawn up jointly with the representatives of EMS Russian Post. 

When asking for a refund, the Customer has to state their passport data or attach a copy of the 1st page of their identity document (according to the Regulations of the Central Bank of the Russian Federation dd. October 12, 2011 No. 373-P: REGULATIONS ON ORDER OF CASH TRANSACTIONS WITH BANKNOTES AND COINS OF THE BANK OF RUSSIA ON THE TERRITORY OF THE RUSSIAN FEDERATION). 

The Customer is also required to attach a sales or cash register receipt, a filled-out application form, as well as a copy of the identity document, and send them to the Seller via the EMS Department of Russian Post together with the Order, declaring the full costs and the inventory of the enclosed items, using the following address of the Seller: IP Varivoda E.V. 103 Oktyabrskaya Street, bldg 2. Moscow, 127521.

In case of return of inadequate-quality Goods or a mistakenly sent item, the shipping costs will be refunded to you once the return has been processed. At the request of the Customer, the Seller either exchanges the Goods or returns the amount paid for the Goods.

If there is a dispute about the causes of defects or the fact of the Goods use or intactness of their marketable state, an independent examination of the Goods will be carried out. The Customer has the right to participate in the quality control of the Goods and to dispute the examination results at court. If the examination of the Goods is carried out, the claims for the return of the amount paid for the Goods shall be settled within 20 days from the date of the relevant claim presentation.

Refund

In order for the money to be refunded to the Customer it is necessary that the Goods are sent only by EMS Russian Post. 

In case of the Customer's refusal of the Goods (return of the Goods) after the payment has been made and the Order has been received, the refund of the paid amount (whether it was made in cash or by any other non-cash payment method) to the Customer will be made by transferring the necessary amount to the bank account or a bank card specified by the Customer. 

The refund shall be carried out based on a written Application indicating the last name/name and bank details for the refund, and shall be done only upon the presentation of an identity document (passport or other document replacing it). The confirmation of payment with the provision of supporting documents is an absolute prerequisite for the refund. 

If the Seller initiates a cancellation/partial cancellation of the Order, the return of the amount paid for the Goods shall be made (the Customer is required to send an e-mail indicating the payment details to info@dressone.ru from the e-mail address specified during the Order placement.
